			<content:encoded><![CDATA[<p></p><p>Next time you hear someone wondering why the United States’ status in the world has become so greatly diminished or why America has become a target for terrorism, consider asking them if they’ve seen the movie Red Dawn.  In Red Dawn, the United States is invaded by the Soviet Union and a small band of freedom fighters (The Wolverines) fights against their imperial rule.</p>
<p><a href="http://www.pleaseheedthecall.org/wp-content/uploads/2011/11/S-1867-NSDAA.jpg"><img class="alignright size-full wp-image-69719" style="margin: 5px; border: 0pt none;" title="S-1867-NSDAA" src="http://www.pleaseheedthecall.org/wp-content/uploads/2011/11/S-1867-NSDAA.jpg" alt="" width="150" height="150" /></a>Why is is that when we watch movies like Red Dawn, Star Wars, or Avatar, we are repulsed by the concept of imperialism yet we complacently go along with our country’s unsatiable quest for empire?</p>
<p>The idea of “live and let live” still runs strongly through the veins of most Americans.  We still value freedom and liberty but we allow our government to pursue overseas “assets”, build bases, and subjugate populations around the globe.  We have been tricked into thinking that these interventions are for their own good.  They tell us that they need to topple a despotic dictator, create democratic governments, pave the way for free markets, or fight terrorism before it hits our shores.  The reality is much different.  The reality is an unfettered quest for power and control by men and women whose only aim is to further their domination of others.</p>
<p>The recently proposed <a href="http://www.huffingtonpost.com/2011/11/29/senate-votes-to-let-military-detain-americans-indefinitely_n_1119473.html">National Defense Authorization Act (NDAA)</a>, proposed by <a href="http://www.pleaseheedthecall.org/senator/carl-levin/">Senators Carl Levin of Michigan</a> (202 &#8211; 224 &#8211; 6221) and <a href="http://www.pleaseheedthecall.org/senator/John-Sidney-McCain/">John McCain of Arizona</a> (202 &#8211; 224 &#8211; 2235), would allow the U.S. Military to detain Americans without trial anywhere in the world.  <a href="http://www.pleaseheedthecall.org/senator/mark-e-udall/">Senator Mark Udall of Colorado</a> (202 &#8211; 224 &#8211; 5941) has proposed an ammendment that would remove the portions of this bill that deal with indefinite detention.</p>
<p>Please consider calling these senators as well as your own senator to express opposition to this bill or to thank them for opposing it.</p>

			<content:encoded><![CDATA[<p></p><p>“Any person subject to this chapter who—</p>
<p>(1) violates or fails to obey any lawful general order or regulation;</p>
<p>(2) having knowledge of any other lawful order issued by a member of the armed forces, which it is his duty to obey, fails to obey the order; or</p>
<p>(3) is derelict in the performance of his duties; shall be punished as a court-martial may direct.”</p>
<p><em><strong>Elements. </strong></em></p>
<p>(1) <em>Violation of or failure to obey a lawful general order or regulation</em>.</p>
<p>(a) That there was in effect a certain lawful general order or regulation;</p>
<p>(b) That the accused had a duty to obey it; and</p>
<p>(c) That the accused violated or failed to obey the order or regulation.</p>
<p>(2) <em>Failure to obey other lawful order</em>.</p>
<p>(a) That a member of the armed forces issued a certain lawful order;</p>
<p>(b) That the accused had knowledge of the order;</p>
<p>(c) That the accused had a duty to obey the order; and</p>
<p>(d) That the accused failed to obey the order.</p>
<p>(3) <em>Dereliction in the performance of duties</em>.</p>
<p>(a) That the accused had certain duties;</p>
<p>(b) That the accused knew or reasonably should have known of the duties; and</p>
<p>(c) That the accused was (willfully) (through neglect or culpable inefficiency) derelict in the performance of those duties.</p>
<p><em><strong>Explanation. </strong></em></p>
<p>(1) <em>Violation of or failure to obey a lawful general order or regulation</em>.</p>
<p>(a) General orders or regulations are those orders or regulations generally applicable to an armed force which are properly published by the President or the Secretary of Defense, of Transportation, or of a military department, and those orders or regulations generally applicable to the command of the officer issuing them throughout the command or a particular subdivision thereof which are issued by:</p>
<p>(i) an officer having general court-martial jurisdiction;</p>
<p>(ii) a general or flag officer in command; or</p>
<p>(iii) a commander superior to (i) or (ii).</p>
<p>(b) A general order or regulation issued by a commander with authority under Article 92(1) retains its character as a general order or regulation when another officer takes command, until it expires by its own terms or is rescinded by separate action, even if it is issued by an officer who is a general or flag officer in command and command is assumed by another officer who is not a general or flag officer.</p>
<p>(c) A general order or regulation is lawful unless it is contrary to the Constitution, the laws of the United States, or lawful superior orders or for some other reason is beyond the authority of the official issuing it. <em>See </em>the discussion of lawfulness in <a href="http://usmilitary.about.com/library/milinfo/mcm/bl89.htm">paragraph 14c(2)(a)</a>.</p>
<p>(d) <em>Knowledge</em>. Knowledge of a general order or regulation need not be alleged or proved, as knowledge is not an element of this offense and a lack of knowledge does not constitute a defense.</p>
<p>(e) <em>Enforceability</em>. Not all provisions in general orders or regulations can be enforced under Article 92(1). Regulations which only supply general guide-lines or advice for conducting military functions may not be enforceable under Article 92(1).</p>
<p>(2) <em>Violation of or failure to obey other lawful order</em>.</p>
<p>(a) <em>Scope</em>. Article 92(2) includes all other lawful orders which may be issued by a member of the armed forces, violations of which are not chargeable under Article <a href="http://usmilitary.about.com/library/milinfo/mcm/bl90.htm">90</a>, <a href="http://usmilitary.about.com/library/milinfo/mcm/bl91.htm">91</a>, or 92(1). It includes the violation of written regulations which are not general regulations. <em>See also </em>subparagraph (1)(e) above as applicable.</p>
<p>(b) <em>Knowledge</em>. In order to be guilty of this offense, a person must have had actual knowledge of the order or regulation. Knowledge of the order may be proved by circumstantial evidence.</p>
<p>(c) <em>Duty to obey order</em>.</p>
<p>(i) <em>From a superior</em>. A member of one armed force who is senior in rank to a member of another armed force is the superior of that member with authority to issue orders which that member has a duty to obey under the same circumstances as a commissioned officer of one armed force is the superior commissioned officer of a member of an-other armed force for the purposes of Articles <a href="http://usmilitary.about.com/library/milinfo/mcm/bl89.htm">89</a>, and <a href="http://usmilitary.about.com/library/milinfo/mcm/bl90.htm">90</a>. <em>See </em> <a href="http://usmilitary.about.com/library/milinfo/mcm/bl89.htm">paragraph 13c(1)</a>.</p>
<p>(ii) <em>From one not a superior</em>. Failure to obey the lawful order of one not a superior is an offense under Article 92(2), provided the accused had a duty to obey the order, such as one issued by a sentinel or a member of the armed forces police. <em>See </em> <a href="http://usmilitary.about.com/library/milinfo/mcm/bl91.htm">paragraph 15b(2)</a>, if the order was issued by a warrant, noncommissioned, or petty officer in the execution of office.</p>
<p>(3) <em>Dereliction in the performance of duties</em>.</p>
<p>(a) <em>Duty</em>. A duty may be imposed by treaty, statute, regulation, lawful order, standard operating procedure, or custom of the service.</p>
<p>(b) <em>Knowledge</em>. Actual knowledge of duties may be proved by circumstantial evidence. Actual knowledge need not be shown if the individual reasonably should have known of the duties. This may be demonstrated by regulations, training or operating manuals, customs of the service, academic literature or testimony, testimony of persons who have held similar or superior positions, or similar evidence.</p>
<p>(c) <em>Derelict</em>. A person is derelict in the performance of duties when that person willfully or negligently fails to perform that person’s duties or when that person performs them in a culpably inefficient manner. “Willfully” means intentionally. I t refers to the doing of an act knowingly and purposely, specifically intending the natural and probable consequences of the act. “Negligently” means an act or omission of a person who is under a duty to use due care which exhibits a lack of that degree of care which a reasonably prudent person would have exercised under the same or similar circumstances. “Culpable inefficiency” is inefficiency for which there is no reasonable or just excuse.</p>
<p>(d) <em>Ineptitude</em>. A person is not derelict in the performance of duties if the failure to perform those duties is caused by ineptitude rather than by willfulness, negligence, or culpable inefficiency, and may not be charged under this article, or otherwise punished. For example, a recruit who has tried earnestly during rifle training and throughout record firing is not derelict in the performance of duties if the recruit fails to qualify with the weapon.</p>

<p style="text-align: left;">As the <a href="http://en.wikipedia.org/wiki/Abu_Ghraib_torture_and_prisoner_abuse">Abu Ghraib incident</a> attests, the defense of &#8220;I was ordered to do it&#8221; does not stand up in a Court Martial and it certainly does not remove ANY of the personal responsibility that a service member much accept when deciding to follow an order.  If an unlawful order is given by a superior and carried out by a subordinate, they are both at fault both under the UCMJ and under the universal laws of decent behavior and morality that govern human interaction and transcend nationality.</p>
<p style="text-align: left;">Considering this, it amazes me that police officers CONTINUE to use brutality and harsh tactics on the Occupy Movements across this country.  It further amazes me that <a href="http://www.pleaseheedthecall.org/police/lt-john-pikes-personal-phone-number/">Lt. John Pike</a> of the UC Davis police force <a href="http://www.youtube.com/watch?feature=player_embedded&amp;v=6AdDLhPwpp4">ruthlessly pepper sprayed innocent and non-voilent protesters</a> DESPITE the fact that he was a Marine sergeant and therefore very familiar with the concept that <strong>following unlawful orders is not a sufficient defense!</strong></p>
<p style="text-align: left;">To the police officers that read this, I know that the situation you are now in is a classic case of &#8220;a few bad apples&#8221; and that the majority of you are honorable, upright, honest, and even supportive of the Occupy Movements.  Please help me to understand why this continues to happen and what is being done to prevent it.</p>

			<content:encoded><![CDATA[<p></p><p>If the generation that fought and won World War II was considered &#8220;The Greatest Generation&#8221;, would it be out of line to consider the baby boomer generation &#8220;The Worst Generation&#8221;?  The Greatest Generation was born into the poverty of the great depression but ushered in the most prosperous decades that this country has known.  The Baby Boomers were the beneficiaries of this great prosperity, but as each day passes it becomes increasingly evident that by the time they cede control of this country, that prosperity will have all but vanished.</p>
<p>One could look at the Occupy and Tea Party Movements as polar opposites, politically right vs. politically left, small government vs. big government, free market vs. the welfare state, etc.  My contention is that they are th<a href="http://www.pleaseheedthecall.org/wp-content/uploads/2011/11/Venn-Diagram-Occupy-Tea-Party.png"><img class="alignright size-medium wp-image-69699" title="Venn-Diagram-Occupy-Tea-Party" src="http://www.pleaseheedthecall.org/wp-content/uploads/2011/11/Venn-Diagram-Occupy-Tea-Party-300x254.png" alt="" width="300" height="254" /></a>ey are to a great extent the same, a revolt against the world that was created by the baby boomer  generation.  The baby boomer generation has spent 40 years ruling this country.  At the start of their reign, the United States was the manufacturing powerhouse of the world.  The axis powers had been destroyed and the world was dependent on U.S. exports of both food and durable goods.  As their reign ends, goods that are actually made in the United States are an anomaly, something to be featured on NPR rather than the rule.  U.S. manufacturing used to be a major engine of the world economy, U.S. consumption has now taken over this role &#8230; &#8220;the consumer&#8221; rather than &#8220;the factory&#8221;.  U.S. loans used to spur development and innovation worldwide, today we have become the world&#8217;s largest debtor nation and are effectively policy slaves to our creditors.</p>
<p>With our country&#8217;s inability to deal with it&#8217;s debt problems, inability to deal with the severe wealth distribution problems, inability to even pass a budget, it is now time for the Baby Boomers to step aside.  The sentiments expressed by the Tea Party and Occupy Wall Street movements are the same &#8230; it&#8217;s time to move on.  The younger generations are tired of you kicking the can time and time again because we know that that can will end up on our doorstep &#8230; we will have to fix the problems that you caused.</p>
<p>The system that you created is broken.  You pay lip service to &#8220;your kids and grandkids&#8221; and yet do nothing to make this a better country for them.  Your kids and grandkids are now revolting.  Your kids and grandkids have realized that we are not your primary concern.  You have sought after wealth, fame, prestige, and influence and you have got it and we will pay for it.  You will go down in history as &#8220;The Worst Generation&#8221; because of the legacy of destruction that you have left.</p>
